TERM: The TRANS4MATION Program has a term of two to four (2-4) months from the date of the Start Date (or if none is specified, then the date of payment). This is not a membership and cannot be renewed. But a different program or membership may be offered at the discretion of STINKYBODY.
By mutual agreement, this program may be converted to another type of program, or membership, pursuant to a new agreement with STINKYBODY. The term of this Contract may be extended as follows: a. If STINKYBODY temporarily closes for thirty (30) days or less, the term shall be extended for the number of days equal to the number of days that the facility was closed (excluding holidays and any other days the facility is normally closed), at no additional cost to me. b. I may extend the term of this Contract, at no additional cost to me, for the number of days equal to the days comprising the duration of my disability, if my disability precludes me from using one-third (1/3) or more of the STINKYBODY facilities or program for a period of less than one (1) month and that disability is verified by a physician. To extend the term pursuant to this Paragraph. I must give timely notice to STINKYBODY of my request to so extend by written notice at the address/contact info below.
FEE GUARANTEE: Cost of this program may be modified from time-to-time by STINKYBODY.
CANCELLATION: I (or my legal representative) may cancel this Contract without penalty in accordance with the following: If I die or become permanently disabled. A permanent disability means a condition which precludes me from using one third (1/3) or more of STINKYBODY’S program or facilities for one (1) month or more, and the condition is verified by a physician. Upon of cancellation under this Paragraph, STINKYBODY shall refund to me all monies paid in excess of an amount computed by the values below:
- Private Setup Session ($300)
- Private Follow Up Session ($150)
- Private Sessions ($80 per hr)
- Group Class Access ($197 per month)
- Online Module Access ($300)
- Materials, booklets, etc. ($70)
Subtracting all items up to the date of cancellation, including an administrative fee of Fifty ($50) Dollars. STINKYBODY may require, at its expense, a physician examination of me by a physician mutually agreed upon, to verify my disability, and I hereby consent to such examination. d. If I move more than twenty-five (25) miles away from the Lab. Upon cancellation under this Paragraph, STINKYBODY shall refund monies using the same computation described above. e. If the Lab closes for more than thirty (30) days and STINKYBODY fails to provide a comparable facility within ten (10) miles of the Lab, I may cancel this contract upon written notice to STINKYBODY. Upon cancellation, I shall be entitled to a refund of all monies paid in excess of an amount computed by dividing the full contract price, including any initiation fee, by the number of weeks in the contract term and multiplying the result by the number of weeks elapsed in the contract term. f. The buyer shall notify STINKYBODY of cancellation in writing, by certified mail, return receipt requested, or by personal delivery to the address specified by STINKYBODY; all money to be refunded upon cancellation of the fitness contract shall be paid within forty (30) days of receipt of the notice of cancellation; if buyer has executed a credit, lien, or automatic funds transfer agreement with STINKYBODY to pay for fitness services, any negotiable instrument or credit or lien agreement executed by the buyer shall also be returned and any automatic transfer shall be canceled within forty (30) days after the cancellation.
RESULTS GUARANTEE: The definition of results refers to weight, body fat percentage, blood pressure, triglyceride level, strength, and flexibility measures. Measurements are recorded and logged for reference. Please note that it’s not easy to get health and fitness results but with our system you can–easier than most. But you have to put forth the effort. If you put forth effort but don’t get results, you are eligible for a full refund. However, you must show evidence of your effort. This may include attendance to Group Training Sessions, videos of home exercises being performed, communication and interaction within the online community and/or coaches. If you don’t put forth effort but expect to see results, this program is not for you.
